How much do you charge for legal services?
At Da Silva Legal Services fees are based on the total amount recovered for you. The fee will be on a contingency basis which means YOU DON’T PAY UNLESS WE RECOVER MONEY FOR YOU.
How much will I receive?
This is a very common question asked by our clients during their initial consultation. Before we can estimate the value of your case we must assess several key elements such as the severity of the injuries you sustained and how those injuries affect your future and your ability to work and live a normal life. You are entitled to future benefits if your injuries prevent you from achieving a full and complete recovery which in turn prevents you from performing your everyday duties. We take every necessary step to ensure that you are compensated for all of your economic losses, medical and rehabilitation bills and all other reasonable and necessary out-of-pocket expenses in connection with your accident.
How long will it take to receive compensation?
The length of time it takes to settle your claim depends on a number of factors such as how complex or simple your case poses to be, the severity of the injuries you sustained and how long it takes you to fully recover. Most motor vehicle accidents take between 1-3 years to achieve a fair settlement. We will not advise you to accept any insufficient offers or cut any corners regarding your case. What if the accident was my fault?
If the accident was your fault you are still entitled to No-Fault Accident Benefits. Every insurance policy offers coverage in different circumstances. What if I don't have insurance?
If you have been injured in a car accident and you do not have your own insurance policy or you are not listed on another person’s policy, you are still entitled to Accident Benefits. You may claim benefits from the insurance company of the at-fault party or if you and the other party involved in the car accident don’t have automobile insurance, and no other insurance policy is available to you then you may be entitled to obtain Accident Benefits from Ontario’s Motor Vehicle Accident Claims Fund (MVACF). What benefits am I entitled to?
Depending on the elements of your accident, the severity of your injuries and your own circumstances you may be entitled to selected Accident Benefits under your automobile insurance policy such as: Income Replacement, Non-Earner, Caregiver, Medical and Rehabilitation, Attendant Care, Housekeeping and Home Maintenance and Death and Funeral Benefits.

Will the Insurance Company continue to pay my medical bills after we settle?
Medical bills that you will induce after your case has been resolved are considered to be future medical and rehabilitation costs. We will fight to ensure that your settlement contains compensation for your future medical and rehabilitation costs, if any. Once you have agreed to the settlement terms, signed the full and final release and the settlement funds have been paid you, you will not receive any more payments.
